Peer Product Review

At other times attorneys might hire mental health professionals for the purpose of reviewing a finished product (typically a forensic evaluation conducted by another mental health professional) in cases in which the recommendations of the forensic expert are not favorable to the attorney’s client. The purpose of hiring a mental health professional under these circumstances is to attempt to develop a coherent strategy designed to attack the foundations of the finished forensic product to undermine its conclusions.

Elements that can be the focus of such review can include the following:

  • To determine whether the report abided by procedural and guideline standards recommended in the industry.
  • To determine whether the methodology employed in the work product is based on sound scientific principles.
  • To determine whether the finished product recommendation section is consistent with the main thrust contained in the body of the report.
